KWSCreate Terms and Conditions
Thank you for choosing KWSCreate, your one-stop app for Key Word Sign line drawings, video demonstrations and templates to make customised resources.
With over 1000 line-drawings, 850 videos, a library of templates and now with Picture Communication Symbols, you can create engaging resources to support learning, communication and inclusion at home, school, work and in the community.
These Terms and Conditions (Terms) apply to your use of KWSCreate. KWSCreate is a subscription-based service, accessed through the ‘Members’ section of the Key Word Sign Australia website www.kwsa.org.au/ (Website).
Both KWSCreate and the Website are owned and operated by Scope (Aust) Ltd (ABN 63 004 280 871), trading as Key Word Sign Australia (referred to as “we” or “us”).
In addition to these Terms, your use of the Website and KWSCreate is subject to the KWSA Website Terms of Use (www.kwsa.org.au/terms-conditions/) and our Privacy Policy which is available here: www.scopeaust.org.au/privacy-policy/
Before purchasing a subscription to KWSCreate, you must accept these Terms and Conditions (Terms). Please read these carefully before completing your purchase.
1. Your subscription
Currently KWSCreate is available as a 6-month, 12-month, or 24-month individual subscription, or as a 12-month group subscription – this means that you can choose the best value option for your needs.
Your subscription will automatically renew at the end of the current subscription period, unless you decide to cancel or opt-out. We will send you a notification email one month before the scheduled renewal date, confirming the renewal date, the renewal term and the amount to be charged for renewal.
If you wish to renew your subscription at that point, you do not need to do anything further. Your credit card will be charged, and a record of your purchase will appear in your account history.
If you do not wish to renew your subscription, you will have the option to cancel through the link provided in the email.
You may also cancel your subscription at any time through KWSCreate. We are unable to provide a partial refund if you cancel during the term of your subscription, however you will not be charged any renewal fee at the end of the current subscription period and will retain access to KWSCreate until that subscription period expires.
2. Your use of KWSCreate and KWSCreate resources
While your subscription is active, you may access KWSCreate through the ‘Members’ section of the Website.
By using KWSCreate, you can view an extensive library of Key Word Sign content and create customised resources using templates, line drawings, picture communication symbols and other content.
You may print, reproduce, and use the information in, and retrieve files containing software or images from KWSCreate for non-commercial, personal, or educational purposes only, provided that you:
- do not modify that content;
- include any copyright and/or trademark and/or patent notice, as applicable, originally included with such information and this notice in all such copies.
Your subscription is for your personal use only. You are not permitted to share your log-in details with another person or use your subscription for any commercial purpose, including to on-sell your subscription to any third party.
3. Pricing
We charge in Australian dollars and by purchasing your subscription you agree to pay the subscription price at the payment intervals stated at the time you order your subscription. Discounts only apply if they are included in your subscription order.
We reserve the right to change our pricing and fees at any time. These changes will not affect your current subscription period, and will only apply to any renewed or new subscriptions you sign up to after the pricing increase.
Subscription fees are not refundable except to the extent expressly set out in these Terms.
4. Your Account and Password
If you choose, or you are provided with, a user identification, password, or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.
We have the right to disable any user identification or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use. If you know or suspect that anyone other than you knows your user identification or password, you must take all reasonable steps to secure your account (including immediately changing your password) and notify us at keywordsignaustralia@scopeaust.org.au.
5. Changes to KWSCreate
We can modify the content, inclusions, type and availability of KWSCreate at any time for example by adding new content sections or changes to its functionality.
However, please note that any of the content may be out of date at any given time, and we are under no obligation to update it. We do not guarantee that KWSCreate, or any content on or created through it, will be free from errors or omissions.
6. Changes to these Terms
We reserve the right at any time to modify these Terms without notice at any time. We will not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of KWSCreate.
7. Intellectual Property Rights
Unless indicated otherwise, the copyright and other intellectual property rights contained within or generated through KWSCreate are owned by us.
The line drawing images contained within KWSCreate (see below) are the copyright of Key Word Sign Australia Victoria Inc. and are used with permission.
The Picture Communication Symbols contained within KWSCreate (see below) are copyright of Tobii Dynavox, LLC. and are used with permission.
Any resources or content you generate through KWSCreate must contain the following wording. KWSCreate will automatically ensure that these words are included on user-generated content, and you must not do anything to remove, edit or obscure that wording:

8. No Reliance on Information
The content on KWSCreate is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action based on the content on KWSCreate.
Although we make reasonable efforts to update the information on our websites/apps, we make no representations, warranties or guarantees, whether express or implied, that the content KWSCreate is accurate, complete, or up to date.
9. General
The failure of us to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
These Terms and any policies or operating rules posted by us on this Website constitutes the entire agreement and understanding between you and us and govern your use of the Website, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms).
If any part of these Terms is found to be void, unlawful, or unenforceable then that part will be deemed to be severable from the balance of these Terms and the severed part will not affect the validity and enforceability of any remaining provisions.
These Terms will be governed by and interpreted in accordance with the law of Victoria, Australia without giving effect to any principles of conflicts of laws. You agree to the exclusive jurisdiction of the courts of Victoria, Australia to determine any dispute arising out of these Terms.
